EarnDrift Independent Partner Agreement
Last Updated: July 2026
This Independent Partner Agreement ("Agreement") governs your participation in the EarnDrift Referral Partner program. By submitting an application, you acknowledge you have read, understood, and agree to be bound by the terms below.
1. Nature of Relationship
You are applying to act as an Independent Referral Partner ("Partner") for EarnDrift. This agreement does not create an employer-employee relationship, partnership, or joint venture. You are an independent contractor (1099). You have full control over your hours, methods, and location of work.
2. Compensation & Earnings
This is a 100% commission-based opportunity. EarnDrift provides no guaranteed base salary, hourly wage, or health care benefits. Commissions are only earned on qualifying, successful customer payments as outlined in the Partner Portal. Results are not guaranteed and depend entirely on your personal effort and skill.
3. Taxes & Operating Expenses
As an independent business entity, you are solely responsible for filing and paying all local, state, and federal taxes on your commissions. EarnDrift will not withhold taxes. You are also solely responsible for any expenses incurred while acting as a Partner (e.g., travel, internet, phone bills).
4. Code of Conduct & Anti-Spam Policy
You agree to represent EarnDrift professionally and honestly. You explicitly agree to comply with all local and federal communication laws, including but not limited to the CAN-SPAM Act and the Telephone Consumer Protection Act (TCPA).
Strictly Prohibited Actions:
- Purchasing lists for unsolicited bulk emailing.
- Using automated robocallers or mass SMS blasters.
- Making false claims about EarnDrift's software capabilities or pricing.
Violation of this Anti-Spam Policy or misrepresentation of the brand will result in the immediate termination of your Partner account and forfeiture of all pending commissions. EarnDrift reserves the right to terminate any Partner at any time for unprofessional conduct.
5. Commission Terms
- Commission equals 100% of the referred customer's first paid month of EarnDrift subscription, between $129 to $499 depending on the plan the customer purchases.
- The commission amount is fixed at qualification and is not repriced afterward if the customer later changes plan.
- The qualifying event is the successful clearing of the referred customer's first paid EarnDrift subscription invoice. Trial-start $0 invoices do not qualify.
- 50% is paid on the customer's first billing cycle. The remaining 50% is paid at day 30, provided the customer is still subscribed on day 30.
- Payouts are made by direct deposit on the 1 and the 15 of each month via Stripe Connect.
- A SaaS refund within 30 days claws back the fast half. The retention half pays only if the customer is still subscribed on day 30.
- There are no quotas, no caps, and no set hours.
- A completed W-9 is required before the first payout. A 1099-NEC is issued when the IRS reporting threshold is met.
6. Termination and Forfeiture
Forfeiture of unpaid commissions applies only to termination for serious or repeated violations of Section 4 (Code of Conduct & Anti-Spam Policy). A Partner terminated for any other reason remains entitled to commissions already earned, and those commissions will be paid on the next regular payout cycle following termination.
